Contact: contact@iolo.paris
The Website offers:
-
Products: Korean and European objects and decorative items (the "Products");
-
Consulting Services: creative and commercial consulting services (the "Services");
-
Applications: software applications and related digital content (the "Applications").
By placing an order, the Customer confirms that they have read and accepted these Terms. We may update these Terms at any time. The version in force on the date of the order applies.
2. Ordering
2.1. To order, the Customer selects the Products, Services or Applications, adds them to the cart, enters the required information, and confirms the order after accepting these Terms and paying.
2.2. The order is formed when we send an order confirmation email. We may refuse or cancel an order for a legitimate reason, in particular in the case of non-payment, suspected fraud, an abnormal order, or unavailability of the item. In that case the Customer is refunded any amount already paid.
2.3. The Customer must provide accurate and complete information. We are not responsible for delivery failures caused by incorrect details.
3. Product Information
We make every effort to describe and display our Products accurately. Many items are handcrafted or traditional pieces, so small variations in color, size, finish, grain or pattern are normal and are not defects. Photographs are for illustration only, and the colors shown may differ slightly depending on your screen.
Products are offered while stocks last. If a Product becomes unavailable after an order, we will inform the Customer as soon as possible and may offer an alternative or a full refund.
4. Prices
4.1. Prices are shown in euros (EUR) including VAT, as indicated on the Website. Delivery costs are shown separately before the order is confirmed.
4.2. We may change our prices at any time, but the price applicable to an order is the price displayed at the time the order is placed.
4.3. For deliveries outside the European Union, customs duties, import taxes and local fees may apply. They are not included in our prices, are the Customer's responsibility, and are payable on delivery or to the customs authority.
5. Payment
5.1. Payment is due in full at the time of the order, unless we have agreed otherwise in writing. We accept the payment methods displayed at checkout (for example credit or debit card, PayPal and other methods enabled on the Website).
5.2. Payments are processed by secure third-party payment providers. We do not store the Customer's full card details.
5.3. We may suspend or cancel an order if payment is declined or if the payment provider reports a risk of fraud.
5.4. For special orders, bulk orders or business customers, we may require full payment (100%) before preparing or shipping the goods.
6. Shipping and Delivery of Products
6.1. We deliver to the countries listed on the Website. Delivery fees and estimated delivery times are shown at checkout and depend on the destination and the shipping method chosen.
6.2. Delivery times are estimates and not guarantees. Unless a different date was agreed, we will deliver the Products without undue delay and in any case within 30 days of the order confirmation, in accordance with applicable consumer law.
6.3. Risk of loss or damage passes to the Customer when the Customer, or a third party they designate (other than the carrier), takes physical possession of the Products.
6.4. The Customer must check the parcel on delivery. In case of visible damage or missing items, the Customer should note reservations on the carrier's delivery document and contact us within 3 working days at [email], with photographs.
6.5. If a parcel cannot be delivered because of an incorrect address or because the Customer is absent, additional shipping costs may be charged.
7. Right of Withdrawal (Products)
7.1. If the Customer is a consumer located in the European Union, they have the right to withdraw from the purchase of Products without giving any reason within 14 days after receiving the Products.
7.2. To exercise this right, the Customer must notify us of their decision clearly (for example by email to contact@iolo.paris) before the end of the 14-day period. They may use the model withdrawal form below, but this is not mandatory.
7.3. The Customer must return the Products within 14 days of notifying us of the withdrawal, at their own expense, unless we have agreed to cover the cost. Products must be returned in their original condition and packaging, unused and properly protected. The Customer is liable for any loss in value resulting from handling beyond what is necessary to check the nature and condition of the Products.
7.4. We will refund all payments received, including standard delivery costs, within 14 days of receiving the withdrawal notice. We may withhold the refund until we have received the Products back or until the Customer provides proof of return. The refund is made using the same payment method as the original transaction.
7.5. The right of withdrawal does not apply to, in particular: vintage items, customized or made-to-order Products; sealed Products such as socks that cannot be returned for hygiene or health protection reasons once unsealed; and any other case excluded by law.
Model withdrawal form: To iOLO Paris, 61 bis rue Planchat 75020 Paris France. I hereby notify you that I withdraw from my contract for the sale of the following goods: [description], ordered on [date], received on [date]. Name: [name]. Address: [address]. Date: [date]. Signature (only if on paper).
8. Returns, Damaged or Defective Items
8.1. Customers outside the European Union may be subject to the return rules of their local law. We will in any case consider reasonable return requests made within 14 days of delivery, subject to the same condition requirements as above.
8.2. If a Product arrives damaged, defective or not as ordered, the Customer should contact us at [email] within the timeframe set out in section 6.4 with photographs. We will offer a replacement, repair or refund, and we will bear the return costs in these cases.
Consumers benefit from the legal guarantee of conformity applicable in their country of residence. In the European Union, the Seller is liable for any lack of conformity of the goods existing at the time of delivery and appearing within two years of delivery. The Customer may choose between repair and replacement, subject to the conditions provided by law, and may request a price reduction or termination of the contract if these remedies are not possible or not provided in time. The Customer also benefits from the legal guarantee against hidden defects under the applicable law. These rights apply without prejudice to any commercial guarantee we may offer.
10. Consulting Services
10.1. Scope. Consulting Services (for example business development, market research, art direction and creative projects) are provided according to the description on the Website or, for tailored work, according to a written proposal, quote or contract (the "Proposal") accepted by the Customer. In case of conflict, the Proposal prevails over these Terms.
10.2. Fees and payment. Fees are those stated on the Website or in the Proposal. Unless agreed otherwise, fees are payable in advance or according to the payment schedule in the Proposal. Late payment may lead to suspension of the Services and to late-payment interest and recovery costs as allowed by law.
10.3. Performance. We perform the Services with reasonable skill and care and are bound by an obligation of means, not of result. The Customer agrees to provide the information, materials, access and approvals reasonably needed in a timely manner. Delays caused by the Customer may postpone deadlines and may affect fees.
10.4. Rescheduling and cancellation. Meetings may be rescheduled free of charge if requested at least [48 hours] in advance. Later cancellations, or no-shows, may be charged in full. Cancellation of work already started is subject to payment for work performed up to that point.
10.5. Right of withdrawal for Services. Consumers in the European Union have 14 days to withdraw from a Service contract. If the Customer asks us to begin the Services during that period, they must pay a proportionate amount for the Services provided up to the time of withdrawal. Once the Services have been fully performed with the Customer's prior express consent and acknowledgement that they lose their right of withdrawal, the right no longer applies.
10.6. Confidentiality. Each party keeps confidential the non-public information received from the other party in connection with the Services and uses it only for the purposes of the Services.
10.7. Intellectual property of deliverables. Unless stated otherwise in the Proposal, and subject to full payment, the Customer receives a non-exclusive right to use the final deliverables for their own business purposes. We keep ownership of our pre-existing materials, methods, tools and know-how. We may refer to the work in our portfolio unless the Customer objects in writing.
11. Applications and Digital Content
11.1. Licence. Subject to these Terms and payment of the applicable price, we grant the Customer a personal, non-exclusive, non-transferable, revocable licence to download, install and use the Application for its intended purpose. All intellectual property rights in the Application remain with us or our licensors. The Customer may not copy, modify, decompile, reverse engineer, resell, sublicense or distribute the Application, except as permitted by mandatory law.
11.2. Delivery. The Application is delivered by download link, access code, account activation or distribution through a third-party app store, as indicated on the product page. Delivery is deemed made when the access is made available to the Customer.
11.3. Right of withdrawal. For digital content not supplied on a physical medium, the right of withdrawal is lost once performance has begun, with the Customer's prior express consent and acknowledgement that they lose their right of withdrawal as soon as the download or access starts. The Customer will be asked for this consent at checkout.
11.4. Updates, support and compatibility. We provide updates and support as described on the product page. The Customer is responsible for checking that their device and software meet the minimum requirements. Consumers keep their statutory rights for digital content that is not in conformity.
11.5. Subscriptions. If an Application is offered by subscription, the price, billing period, renewal terms and cancellation method are shown before purchase. The subscription renews automatically unless cancelled before the end of the current period.
11.6. Third-party platforms. If an Application is downloaded through a third-party platform, that platform's terms also apply.
12. Intellectual Property
All content on the Website, including texts, photographs, images, graphics, logos, trademarks, product descriptions, software and design, belongs to us or our licensors and is protected by intellectual property laws. Any reproduction, extraction or use without our prior written consent is prohibited.
13. Liability
13.1. Nothing in these Terms excludes or limits liability that cannot legally be excluded, including liability for death or personal injury caused by negligence, fraud, or the statutory rights of consumers.
13.2. Subject to the above, and for professional customers, our total liability for any claim relating to an order is limited to the amount paid for the Product, Service or Application concerned. We are not liable for indirect or consequential losses, such as loss of profit, loss of business opportunity or loss of data.
13.3. Our Products are decorative or household objects and must be used as intended. Items such as glass or ceramic pieces should be handled with care. Unless a Product is expressly described as food-safe, dishwasher-safe or microwave-safe, it should not be assumed to be.
13.4. Consulting Services provide professional advice and recommendations. The Customer remains responsible for their own business decisions.
14. Force Majeure
Neither party is liable for a failure or delay in performing its obligations caused by an event beyond its reasonable control (force majeure), such as natural disasters, epidemics, war, strikes, transport or customs disruptions, supplier failures, or failures of electricity, telecommunications or internet networks. The affected party will inform the other and resume performance as soon as possible. If the event lasts more than 60 days, either party may terminate the affected order, and amounts paid for undelivered items will be refunded.
15. Personal Data
We collect and process personal data in accordance with our Privacy Policy available at [link], in compliance with the General Data Protection Regulation (GDPR) and applicable law. The Customer has rights of access, rectification, erasure, restriction, objection and portability, which can be exercised by writing to [email].
16. Customer Service and Complaints
For any question or complaint, contact us at [email]. We will reply within [5] working days.
If a dispute is not resolved, a consumer may use a free consumer mediation service. Mediator: [name and contact details of the consumer mediator]. EU consumers can also use the European Commission's online dispute resolution platform where available.
17. Governing Law and Jurisdiction
These Terms are governed by [French] law. Consumers keep the benefit of the mandatory consumer protection provisions of the law of their country of residence. For disputes with professional customers, the courts of [city] have exclusive jurisdiction. For consumers, disputes may be brought before the competent courts under applicable law.
18. General Provisions
If any provision of these Terms is found invalid or unenforceable, the remaining provisions stay in force. Our failure to enforce a right is not a waiver of that right. The Customer may not transfer their rights or obligations under these Terms without our written consent.
